Potential Pitfalls and Recent Developments


This seminar will consider the nature and scope of “casual employment” in light of the Full Court of the Federal Court’s decision in Workpac Pty Ltd v Skene [2018] FCAFC 131, and the indicia courts will consider in determining whether a casual employee is in fact engaged in permanent employment. 
 
The seminar will also address the civil penalty regime of the Fair Work Act 2009 and recent legislative developments and guidance from the federal courts as to what conduct by employers may mitigate or increase their exposure to civil penalties.
