Challenging Grants of Representation:
Grounds of Objection in Caveat Proceedings and Applications for Revocation of a Grant


Recently, the Supreme Court of Victoria has handed down a number of detailed decisions relating to the challenge of grants of representation in respect of both caveat proceedings and applications for revocation of a grant.  The decisions deal with:

* The appropriate procedure for challenging a grant of representation

* The standing of applicants to bring a proceeding

* What constitutes a prima facie case

* The relevant legal tests for undue influence, testamentary capacity and knowledge and approval
