Summary

This first part of this presentation will provide an update on how the equitable doctrines of undue influence, unconscionable conduct and proprietary estoppel are currently being used in wills and estates litigation.  The second part will explore the elements of these three equitable claims and provide practical guidance to practitioners on how to properly plead them.
