Summary :

In this seminar Robert Hay QC and Brett Harding will revisit the fundamentals of caveats, and explore the ever-challenging question: ‘What is a caveatable interest?’ They will discuss recent cases where judges have made stern statements about the conduct of practitioners who lodge improper caveats, and the consequences. They will also consider applications made by registered proprietors where they have suffered loss by reason of caveats being lodged ‘without reasonable cause’.
