List member Tim Donaghey has prepared a casenote of a decision handed down by the New South Wales Court of Appeal: Agha v Devine Real Estate Concord Pty Ltd [2021] NSWCA 29. This case though discusses breaches of obligations, and use of confidential information, it is significant regarding the limitations of the use of inferences derived from evidence.
