Informal Computer Will

In a recent decision handed down by Her Honour Justice McMillan, an informal computer will was admitted to probate pursuant to s.9 of the Wills Act 1997 with leave reserved to the defendant. The informal will was found to have been typed by the testator, prior to taking his own life. The objection to the application was that the testator lacked testamentary capacity and that the typed computer will was not intended by the testator to be his final will.
