Justice Legislation Amendment (Succession and Surrogacy) Bill 3014

TRANSITIONAL PROVISIONS

Practitioners’ attention is specifically drawn to the change in the transitional provisions in the amended version of the Bill.

The new Act (when passed) will now only apply to the estate of a person who dies on or after the commencement of the Act.

The Bill continues to provide that the amended Act will come into operation on 1 July 2015 if not proclaimed before that date.

This means that pending applications, whether filed or not, will not be affected by the amendments to the Act. There is no need to file urgently to preserve a claimant’s right to bring an action against an estate.
