Third floor determination – part II

Further to my last post on the third floor determination, here is a copy of the Court’s reasons that were published today.

It is worth noting that the Minister appears to have power under s 5(1B) of the RLA to make a retrospective determination, so there would be nothing preventing the determination being re-made with retrospective effect (thanks to Jamie Bedelis for pointing that out).
