This Zoom CPD Update discusses the extension and variation of the Commercial Tenancy Relief Scheme by the COVID-19 Commercial and Residential Tenancies Legislation Amendment (Extension) Act 2020 (Vic) and the COVID-19 Omnibus (Emergency Measures) (Commercial Leases and Licences) Miscellaneous Amendments Regulations 2020 (Vic) that:
* extends the operation of the CTRS to 31 December 2020;
* changes the way in which requests for rent relief are made;
* requires the landlord’s offer of rent relief to be proportionate to the tenant’s decline in turnover associated with the premises; and
* allows a tenant to seek a binding order for rent relief from the Victorian Small Business Commission.
