Commercial matters


Gisela's commercial practice focuses primarily on contractual disputes, with particular experience in building and construction matters. 


Gisela regularly acts for owners, contractors, subcontractors and insurers in construction disputes and has experience across a spectrum of domestic and commercial building matters. Her experience includes claims relating to rectification of cladding issues, defective building works, non-compliance with building regulations, and claims relating to time and cost issues arising under construction contracts.


Gisela has appeared for clients in the Victorian Civil and Administrative Tribunal, as well as in the Magistrates' Court, County Court and Supreme Court.


Gisela’s commercial practice also includes other contractual and commercial disputes, including breach of contract claims, debt recovery matters and proceedings under the Australian Consumer Law.


Regulatory matters 


Gisela's criminal practice focuses on corporate and regulatory crime, including prosecutions under occupational health and safety laws, the Building Act 1993 (Vic) and the Corporations Act 2001 (Cth). 


Gisela has experience as both a prosecutor and defence counsel and appears in the Magistrates’ Court in regulatory prosecutions, including on behalf of the Victorian Building Authority. She has successfully negotiated plea outcomes as defence counsel with regulators such as WorkSafe and the Australian Securities and Investments Commission.


Prior experience and qualifications


Prior to joining the Bar, Gisela was the Associate to the Honourable Justice Terry Forrest in the Victorian Court of Appeal. She also practised as a solicitor in construction litigation at Clayton Utz in Melbourne.


Gisela holds a Bachelor of Arts and Bachelor of Laws (Hons) (First Class) from Monash University. She read with Carmen Currie and her senior mentor is Justin Bourke KC.
