Summary

Clauses governing restraints of trade and the protection of confidential information are an increasingly common feature of employment agreements. Yet when problems arise, parties face significant obstacles in seeking to protect their interests through litigation.

This seminar will outline the key principles and recent case law governing restraint of trade clauses in Victoria, and will provide a practical guide to enforcing (or resisting) these clauses in the higher courts.
