VCAT’s jurisdiction: An endangered species?

Summary

In this Greens List briefing, Robert Hay KC and Brett Harding will discuss recent changes to VCAT's jurisdiction with an emphasis on retail and commercial leasing.

Discussion will include the determination of retail leasing disputes by the Magistrates’ Court under Part 3A of the Victorian Civil and Administrative Tribunal Act 1998 (Vic) following the decisions in Burns v Corbett (2018) 265 CLR 304 and Meringnage v Interstate Enterprises Pty Ltd (2020) 60 VR 361, as well as recent amendments to the Limitation of Actions Act 1958 (Vic).

They will also discuss the potential application of the Sale of Land Act 1962 (Vic) in VCAT.
