Profile

Martin Radzaj is briefed for his expertise in matters involving criminal charges, and issues of impaired decision-making. He excels in preparing strategic litigation advice, as well as delivering persuasive written advocacy in complex matters.  

Martin accepts briefs to appear in cases involving:

• Criminal charges, including drug offences, fraud, Occupational Health and Safety Act breaches, and compulsory hearings. Martin appears in jury trials, appeals, contested hearings, and applications.
• Information disclosure, suppression, and subpoenas.
• Post-sentence applications, including supervision and detention orders under the Serious Offenders Act 2018, the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997, and the Sex Offenders Registration Act 2004.
• Issues of capacity, fitness to stand trial, or impaired decision-making – such as those pursuant to the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997, Guardianship and Administration Act 2019, and Powers of Attorney Act 2014.

Martin delivers training to the legal profession and has taught as a sessional tutor in Federal Criminal Law at La Trobe University. He holds an Indictable Crime Certificate accreditation and was selected for the Trial Counsel Development Program. He graduated from Monash University with a Bachelor of Commerce & Laws and is a national board member of the Australian and New Zealand Association of Psychiatry, Psychology and Law (ANZAPPL), and a member of the Criminal Bar Association. For five years he was on the management committee of Liberty Victoria (Victorian Council for Civil Liberties) and chair of their criminal policy committee.
