Rebecca Tambasco

Rebecca practices in common law and specialises in all areas of health law. She also maintains a commercial law practice.

Rebecca regularly appears led and unled in a variety of matters.

In addition to maintaining her registration as a Registered Nurse in Emergency Psychiatry, Rebecca is an appointed legal member of the Victorian Institute of Forensic Medicine Ethics Committee and a member of the Law Institute of Victoria Health Law Committee. She is also a Teaching Associate at Monash University and has previously taught Australian legal reasoning and methods, trusts law, litigation and dispute resolution and criminal law.

Prior to joining the Bar, Rebecca worked extensively in a variety of public health roles including:

• carrying out critical hospital medical investigations and hospital mortality reviews;
• advising Australian jurisdictions on reforms regarding the National Registration and Accreditation Scheme (and the Health Practitioner Regulation National Law 2009); and
• advising the Health Complaints Commissioner.

Health Law Expertise:

• Medical negligence including cross-over claims with the Australian Consumer Law
• Personal injury including institutional abuse, adoption, forced adoption, COVID19 related matters, fertility, WorkCover, TAC
• Intentional torts including police torts and abuse
• Coronial matters and Cemeteries and Crematoria Act 2003
• Professional regulation and disciplinary proceedings involving registered and non-registered health practitioners under the Health Practitioner Regulation National Law or the Health Complaints Act 2016
• Matters involving government and statutory health authorities including Ahpra, NDIA, Health Complaints Commissioner and Health Regulator
• Public law including Royal Commissions and Inquiries
• Regulation including Voluntary Assisted Dying Act 2017, Food Act 1984, Health Records Act 2001, Privacy and Data Protection Act 1984
• Crimes (Mental Impairment and Unfitness to be Tried) Act 1997

Commercial Law Expertise:

• Trusts law and equity (having previously taught trusts law)
• Australian Consumer Law

Rebecca is also currently involved in a number of class actions.
