Dr Felicity Gerry KC writes on the law on ‘belonging' in relation to women and children in Syrian camps

Felicity’s article on the University of Melbourne Law School McMullen Centre for Statelessness sets out the ancient law on subject-hood (known as ‘belonging’ in Australia) that provides a state’s duty to protect subjects (those who belong). This is the protection of the rule of law which allows for prosecution (or protection the usual sense of the word, such as for those who are trafficked). There is also a line that can be drawn through 800 years of law about a responsibility to collect a person needing protection overseas. It is an area of law not well understood and currently the subject of wide media attention.
